Why was my D8 visa rejected and can I appeal?

A refusal letter names a ground, and the ground is almost always paperwork rather than a judgement about you. That matters, because it decides whether you appeal or simply refile with a better file.

The four that come back most often

Income documentation is first. Bank statements that mix currencies, months that do not line up with the payslips, or an average that lands just under 3,680 euros for 2026. The rule is an average over the last three months of at least four times the minimum guaranteed remuneration, so three clean consecutive months beat a strong annual figure.

Second, unclear proof of remote work. An employee needs a work contract or an employer declaration. An independent needs a partnership agreement, a service contract, a written service proposal or proof of services rendered. A screenshot of an invoice is not any of those.

Third, accommodation. Consulates expect a registered lease of at least twelve months or a deed. A booking confirmation or a rolling short term rental is a classic refusal.

Fourth, form. A criminal record certificate without an apostille, or documents without a certified Portuguese translation, fail regardless of what they say.

The appeal, and the faster alternative

An administrative appeal against a national visa refusal costs 75 euros, and family reunification appeals are exempt from that fee. It is the right move when the decision misread a document you actually filed, because you are asking the same authority to look again at the same file.

When the ground is a genuine gap, refiling is usually faster than arguing. You keep the appointment slot logic of a fresh application and you fix the thing that failed, rather than waiting on a review that will reach the same conclusion.

Before you resubmit

Check the dates on everything. Criminal record certificates and bank statements go stale, and a file assembled in January and filed in June fails on freshness alone. Line up the three month income window so it ends as close to the appointment as the documents allow.
