Can I apply for the D8 visa while I am in Portugal on a tourist stay?

This is the leftover from an older system, and it still circulates in forum threads written before mid 2024. Back then people entered as tourists, registered with social security and filed a manifestacao de interesse to regularise their stay from inside the country. Decree-Law 37-A/2024 closed that on 3 June 2024. Files already lodged continued under transitional rules. No new ones are accepted.

What the route is now

1. Apply at the consulate or visa centre responsible for where you legally reside, with the residency visa document set: application form, two photographs, a passport valid at least three months beyond the stay, an apostilled criminal record certificate, insurance covering medical costs, proof of accommodation and proof of financial resources.
2. Add the D8 layer: an employment contract or employer declaration if you are employed, service contracts, a partnership agreement or a written service proposal if you are independent, a document proving your fiscal residence, and three months of bank statements averaging at least four times the minimum guaranteed remuneration, which is 3,680 euros a month in 2026.
3. If it is approved you get a residence visa valid four months with two entries, fly in, and complete the residence permit with AIMA inside that window.

The scouting trip is still worth taking

Almost everything a consulate wants to see can be assembled while you are in Portugal on a short stay. A NIF from any Financas office, a Portuguese bank account, viewings in person, and a registered lease of at least twelve months, which is the piece most people cannot produce from abroad. What the trip cannot do is move where you file.

Keep the Schengen count honest while you do it: 90 days in any rolling 180 day period, and the days you spend house hunting are the same days you would want for the wait afterwards.

The narrow exceptions

Family members of EU citizens follow Lei 37/2006 rather than the ordinary visa rules, and someone who already holds a Portuguese residence title is changing status rather than applying from scratch. Both are handled case by case. Ask AIMA before assuming you are one of them.
