Do I need a 12 month lease to apply for a Portugal residence visa?

The Ministry of Foreign Affairs document list for the D7 and D8 does not mention accommodation at all. The twelve month expectation comes from consulate practice and from Portuguese rental law itself, not from a checklist item.

What the official list actually asks for

The residency visa documentation pages for digital nomads and for fixed residency list income proof, a work or service contract, a document on your fiscal residence, and the general documents every applicant needs: passport, photos, travel insurance and a criminal record certificate. Accommodation is not among them. Consulates ask for it anyway at the interview or through a supplementary request, because AIMA needs a Portuguese address to schedule your appointment, and because a home is part of what convinces an officer the move is real.

Why twelve months is the working standard anyway

Fixed term residential leases in Portugal have a one year minimum, and a lease of one year or more renews automatically for three years, with the landlord unable to oppose renewal in the first three years without legal grounds. So a normal contrato de arrendamento habitacional already looks like what a consulate wants to see. Advisers list short term or unregistered rental agreements among the most common D8 refusal reasons, alongside weak income evidence and unclear proof that the work is remote.

Registration is the part people miss

A signed contract is not enough on its own. The landlord must register the lease with Financas by the last day of the month following its start, and the registration receipt is what turns your contract into proof of legal address for AIMA. Since 2025 a tenant can register the lease independently once the landlord's window has closed, which is worth knowing if your senhorio is slow or reluctant.

What else consulates accept

  1. A property deed if you bought.
  2. A term of responsibility from a host, sometimes with the host's documents, accepted at some posts.
  3. A long stay booking with a written contract in the meantime, though this is the weakest option and the one that draws questions.

Practice varies by consulate, so check the accommodation wording on the website of the post handling your file before you commit money.

Before you sign

Expect to show a passport or residence card, a NIF, three to six months of income proof, a Portuguese bank account and either a fiador or extra rent in advance. Article 1076 of the Civil Code, as capped by Lei 24-D/2022, limits the deposit to two months rent and advance payment by written agreement to a further two months, so with the first month due at signing, five months of rent upfront is the legal ceiling, not the average bill. The 2026 annual rent update coefficient is 1.0224, a 2.24 percent rise, with at least thirty days written notice required.
