Lisbon rental deposit in 2026: why a 1,400 euro T1 can need 5,600 euros on signing day
A Lisbon rental deposit is capped at two months of rent, but signing day usually costs about four. A sourced model for a 1,400 euro T1, with the no guarantor case.

A Lisbon rental deposit (caução) can legally be no more than two months of rent, but the cash you hand over on signing day is usually closer to four months once the first month and advance rent are added. On a 1,400 euro T1 (one bedroom flat), that is about 5,600 euros before you sleep a single night in it.
This is a model, built only from public, dated sources: the Civil Code limits, published Lisbon rent levels and provider prices. We chose 1,400 euros a month because it sits inside the realistic T1 band of 1,250 to 1,450 euros that Investropa gives for Lisbon (updated 21 September 2026), just above its typical figure of 1,350. How much is the upfront cost to rent in Lisbon?
Plan for about four months of rent in cash on the day you sign. The model below uses the most common structure for a tenant without a Portuguese guarantor who negotiates within the legal limits.

Check the agency line early. Global Citizen Solutions (updated 21 July 2026) puts the agency fee at one to two months of rent for owners who hire an agent. Practice varies, so ask at the first viewing.
What is the legal maximum for a rental deposit in Portugal?
The deposit is capped at two months of rent. Since 1 January 2023, Article 1076 of the Civil Code, as amended by the 2023 State Budget Law (Lei 24-D/2022), limits the caução to the value of two rents. The same article caps advance rent at two months, and only by written agreement (Belzuz Abogados; CompliantLease, 3 January 2026).
Read together, the most a landlord can lawfully ask on the day is usually the first month, two months of deposit and up to two months of advance rent. On the model flat that is 7,000 euros, five months of rent. The model above stops at four because it assumes one month of advance rent, which is the typical ask reported by Imigrata.
Two practical points follow from the law:
- The deposit and the advance rent are different money. The deposit comes back at the end of the lease, minus documented damage. Advance rent is simply rent paid early and is used up month by month.
- There is no statutory deadline to return the deposit. CompliantLease describes 30 days after the lease ends as best practice, and names the arbitration centres CACCL in Lisbon and CICAP in Porto for disputes. Dated photos of every room on key day are your best evidence.
What happens if you have no fiador?
Without a guarantor, landlords ask for more money up front, and some ask for far more than the law allows. A fiador is a Portuguese tax resident with a NIF and a Portuguese tax return who co-signs the lease. Global Citizen Solutions says a fiador is not legally required but is often requested, and that landlords commonly ask foreign tenants with no guarantor for six to twelve months of rent in advance. Imigrata reports that many landlords now accept alternatives such as a larger upfront payment, proof of savings or foreign income documents.
On the same 1,400 euro T1, the scenarios look like this:

The last two rows go beyond the two month advance rent cap in Article 1076. They are reported market practice, not legal limits. If a landlord asks for them, offer bank statements or a letter from your employer or clients instead. What else do you pay in the first month?
The first weeks add a smaller set of one off costs and the first bills. The numbers below come from providers and expat guides, not from a single household.
- Fibre. Unlock Portugal (updated 17 September 2026) says installation is usually free with a 24 month contract, and otherwise costs 60 to 100 euros in activation, with 3 to 10 working days from signing to activation in urban areas.

- Monthly utilities for a one bedroom flat. Portugal Expat Hub (10 June 2026) gives electricity at 35 to 60 euros, water at 12 to 20, gas at 15 to 40 where it applies and basic fibre at 25 to 45. Why does lease registration with Finanças matter?
A lease registered with the tax authority is what turns your contract into proof of a legal address. The landlord must declare the lease to Finanças by the end of the month after the lease starts (DECO). Since 1 August 2025, under Lei 56/2023 and Portaria 106/2025/1, a tenant can file the declaration on the Portal das Finanças if the landlord has not done so by that deadline.
Imigrata notes that consulates and AIMA prefer a registered rental contract as proof of accommodation for residence visas, including the digital nomad visa. How much can the rent rise after you sign?
On an existing lease, the rent can rise once a year by the official coefficient, which is 1.0224 for 2026, a 2.24 percent increase (Aviso 23174/2025/2, published 19 September 2025, listed by the Portal da Habitação). The landlord must give at least 30 days of written notice with the new amount (Cuatrecasas). On the model flat that is about 31 euros a month from the lease anniversary, unless the contract sets another update rule.
New listings move differently. Investropa estimates Lisbon asking rents about 3 percent lower year on year in May 2026, while rents on signed contracts rose through 2025 (see Lisbon rent prices in 2026). The rent you agree first sets your base for years, so negotiate the rent, not only the deposit.
How to prepare for signing day
A short checklist, built from the rules above:
- Budget four months of rent in cash for the day, five if the landlord asks for the legal maximum.
- Ask who pays the agency fee at the first viewing.
- Prepare three months of bank statements and proof of income before you view, because the first complete file often wins the flat.
- Photograph every room with dates on key day, before you move a box in.
- Ask for the Finanças registration reference in writing at the signing table.
- Read the fibre lock in before you accept a free installation.
- Convert your budget into your home currency with the currency check so exchange rates do not surprise you.
