What is a fiador and do I need a guarantor to rent in Portugal?

The fiador is the single biggest obstacle between a newly arrived foreigner and a long term flat, and almost nobody arrives knowing about it.

What signing as fiador means

The fiador signs the contrato de arrendamento alongside you and guarantees your obligations under it. If you stop paying, the landlord can pursue the fiador for the arrears directly, without waiting for a judgment against you. That is why the person has to be somebody with a real stake here: landlords expect a Portuguese tax resident with a NIF, a stable income, often payslips or an IRS assessment, and sometimes property in their name.

It is asked for, not required. Nothing in the Novo Regime do Arrendamento Urbano obliges a tenant to provide one. In practice, a listing agent screening ten applicants will take the one with a fiador over the one without, so the negotiation is about what you offer instead.

What you can offer instead

1. Extra advance rent. This is the usual substitute. Two months of advance rent on top of the deposit is within the legal caps and is often enough. Six to twelve months is commonly asked of foreigners, and that is a negotiation, not a rule.
2. A full document pack. Passport or residence card, NIF, three to six months of payslips or bank statements, a Portuguese bank account, and a letter from your employer or main client.
3. A rent guarantee product. Several Portuguese insurers and lease platforms now sell a guarantee that replaces the fiador for a fee, which some agencies accept.
4. A shorter first contract. Some landlords will sign twelve months with no fiador and renew once you have a payment history with them.

If someone offers to be your fiador

Take it seriously on their behalf. The liability is real, it lasts as long as the guaranteed contract and its renewals, and it can follow them into an enforcement action. Ask a lawyer to check how long the guarantee runs before anybody signs.
