I already have NHR. Do I keep it until my 10 years end?

Holders of the regime have had an unsettling two years of headlines. The rules that ended NHR ended it prospectively.

What you keep

Your status runs for ten consecutive years from the year you became a tax resident, on the treatment in force when you registered. Two versions are in circulation, and which one you have depends on your registration date.

  1. Registered before April 2020: foreign pensions are fully exempt for the whole ten years.
  2. Registered between April 2020 and January 2024: foreign pensions carry a 10 percent flat rate for the whole ten years.

The regime was also closed through a transitional window that accepted applications until 31 March 2025, for people who could prove a qualifying commitment made before 31 December 2023. Statuses approved through that window can run to 31 December 2033.

What you lose at the end

Nothing replaces it. When your ten years expire you move to the ordinary rules: progressive rates of 12.5 to 48 percent for the 2026 tax year, the solidarity surcharge above 80,000 euros of taxable income, and the flat rates that apply to investment income. A pension that was exempt or taxed at 10 percent joins the brackets in full.

Why IFICI is not the next step

Anyone who has benefited from NHR is explicitly excluded from IFICI, as is anyone who used Article 12-A CIRS under Programa Regressar or who has already used IFICI once. So the year your NHR expires is not a renewal date, it is a cliff, and the planning for it belongs to the year before rather than the month after.

Keep your annual Modelo 3 filings consistent while the status runs, since the treatment you claim has to match the version you were granted.
