Can freelancers on recibos verdes qualify for IFICI?

The rate itself is not the obstacle. The Portal das Financas FAQ sets the special 20 percent rate on Category A and Category B income from the qualifying activity, and a freelancer on recibos verdes earns Category B income. The question is which of the five routes you are claiming under.

Where a service contract works

The teaching and scientific research route is the one most commonly accepted for independents. Lecturing at a Portuguese higher education institution, or research carried out inside the national science and technology system, is qualifying activity whether you are on a contract of employment or invoicing for it.

Certified research and development, certified startups and the Madeira and Azores regional routes each have their own entity assessing the file, so the form your contract takes has to be checked against that entity's criteria rather than assumed.

Where it does not

The highly qualified profession route inside an eligible company is built around a hiring relationship. The company has to sit in one of the listed CAE divisions and export at least 50 percent of its turnover in the year of hire or in either of the two preceding years, and you have to hold a PhD, or a degree plus three years of experience. A freelancer invoicing that same company is generally outside it.

The harder case is the one most readers are in: invoicing foreign clients from a desk in Lisbon, with no Portuguese institution anywhere in the chain. There is no qualifying Portuguese activity to attach the claim to, and restructuring as a service provider does not create one.
