Do I need a fiscal representative to get a NIF before I move to Portugal?
Two different situations get confused under one question. Getting a NIF is one thing. Owning property, working or renting in Portugal while you still live abroad is another, and only the second reliably requires a representative.
The two ways to get the NIF
- In person after you arrive: free, same day, at a Financas office or an Espaco Cidadao counter. No representative is involved, because you are physically there to receive your own mail.
- Remotely before you move: usually arranged through a lawyer or a relocation agency, who signs on as your fiscal representative or sets up electronic notifications on your behalf, then sends you the number.
Why a representative used to be compulsory for route two
Before Oficio Circulado 90057 of July 2022, non-EU and non-EEA applicants were told a representative was mandatory to open a NIF from abroad. The circular changed that: a third country resident with no active Portuguese tax obligation who activates electronic notifications on Portal das Financas or the ViaCTT mailbox does not need one, whether they are only getting a NIF or already hold Portuguese assets. EU, Icelandic, Norwegian and Liechtenstein citizens were never required to appoint one.
Why agencies still sell it
Many remote NIF packages still include a year of paid representation by default, because the agency already acts for you during the application and because some providers have not updated their own pages to the 2022 rule. It is not fraud, it is a default you can decline once you know it is optional.
