Portugal residence permit renewal: what is legal when your card expired and the renewal is pending

If you filed your Portugal residence permit renewal and paid the fee, you stay legal in Portugal after your card expires: the renewal receipt has the same effect as the card for 60 days, renewable (article 78(7) of Lei 23/2007), and your right of residence does not lapse for six months after the card's expiry date (article 63(14) of Decreto Regulamentar 84/2007). If you never filed, there has been no general extension to cover you since 15 October 2025.

We read Lei 23/2007 as consolidated up to Lei 62/2026 of 10 September 2026, and Decreto Regulamentar 84/2007 in its current text, both on the Procuradoria-Geral Distrital de Lisboa site, on 26 September 2026. Does Portugal still extend expired residence permits automatically?

No. AIMA announced on 15 October 2025 that expired residence permits stop being valid after that date if the holder has not started a renewal. It called this the end of the extensions by decree, "sem verificação de requisitos", that had run since 2020.

Two cohorts kept a tail after that date:

1. Cards that expired between 22 February 2020 and 30 June 2025 stayed valid until 15 April 2026, as AIMA told Público on 18 October 2025, for holders who had started a renewal.
2. On 2 April 2026, AIMA issued new certificates for the files handled by its Estrutura de Missão task force, valid for 60 days and renewable until the final decision and card issue (DN Brasil, 2 April 2026). They are downloaded from the personal area of the AIMA site.

For a card that expired on or after 1 July 2025, the only protection is the one the law gives every applicant who filed correctly.

What keeps you legal while the renewal is pending?

Three texts do the work, and each covers a slightly different thing.

Read together: the receipt is your document, and the six months is the minimum time your right to live here survives the card. Neither is unlimited. If your file is still silent past six months, get legal advice rather than wait.

The condition is in the word "filed". A renewal exists once it is submitted complete and paid. Since April 2025, AIMA rejects incomplete files instead of pausing them (Jobbatical, 1 September 2026). GrowIN Portugal (updated August 2026), citing AIMA's FAQ, says the DUC payment reference must be paid within 10 working days of being generated, and that the QR coded receipt usually arrives within about ten working days of a paid file. An unpaid reference or a rejected upload can mean there is no renewal at all.

Can you renew a Portuguese residence permit online?

Yes, for most temporary permits. AIMA opened the Portal das Renovações (portal-renovacoes.aima.gov.pt) on 21 July 2025, for residence permit renewals only. It opens in batches by expiry month: on 30 June 2026 VisasUpdate reported it open for cards expiring in September and October 2026. The gov.pt service page (updated 1 September 2026) confirms that holders of a valid or expired permit can request renewal on the AIMA portal.

The timing rules are strict:

1. Article 78(1) of Lei 23/2007 says you must request the renewal up to 30 days before the card expires.
2. Article 63(16) of Decreto Regulamentar 84/2007 opens the window at 90 days before expiry. So the window runs from 90 to 30 days before the date on your card.
3. Pay the DUC as soon as it is generated.
4. Download the receipt and keep it with the card.

Can you travel with an expired card and the renewal receipt?

Inside Portugal, yes. Across a border, it is a risk. AIMA's own position, reported by Público on 18 October 2025, is that an expired card kept alive by the six month rule is not valid outside Portugal, and that only the renewed card allows travel to other European countries. GrowIN Portugal (August 2026) adds that the receipt is not guaranteed to work at a Schengen border or airline check-in, and reports recurring cases of travellers turned away.

The receipt is a Portuguese document. An airline agent in Frankfurt or a border officer in Madrid has no duty to accept it. The people most likely to refuse you boarding are check-in staff at your departure airport, who apply carrier liability rules. A direct flight into Lisbon or Porto carries less risk than a connection through another Schengen country.

What should you keep on your phone?

Keep one offline folder with the documents that prove the renewal exists:

1. The renewal receipt with the QR code, as a PDF.
2. Both sides of the expired card, and the physical card itself.
3. Proof of submission and the paid DUC confirmation, with dates.
4. A one page note in English and Portuguese: permit type, filing date, reference number, and the legal basis (article 78(7) of Lei 23/2007 and article 63(14) of Decreto Regulamentar 84/2007).
5. Your passport, and a return booking into Portugal if you fly.

Employers, banks, landlords, health centres and the tax office inside Portugal usually need only the first two items.

What should you do, in order?

1. Confirm you hold the QR receipt. If you do not, the missing renewal is the emergency, not the trip.
2. Check that the DUC was paid in time and keep the confirmation.
3. Count six months from the expiry date on your card.
4. If your card expired by 30 June 2025 and your renewal is handled by the Estrutura de Missão, download the current 60 day certificate from your AIMA personal area.
5. Postpone travel outside Portugal if you can. If you cannot, fly direct into Portugal.
6. Past six months with no decision, see a lawyer about remedies against administrative silence, which have their own deadlines.
