Overstayed by three days in Thailand? The overstay fine and what happens at the airport

The Thailand overstay fine is 500 THB for each day past your permitted stay, capped at 20,000 THB, and you pay it at the immigration counter when you leave. Three days of overstay therefore costs 1,500 THB, according to the Samut Prakan Immigration Office. If you leave voluntarily and your overstay is under 90 days, there is no re-entry ban. The fine is the small part of the story. The stamp, and the difference between walking up to a counter and being caught, matter more.

How much is the overstay fine in Thailand per day?

The fine is 500 THB per day, and it stops rising at 20,000 THB. The Samut Prakan Immigration Office states that you must pay "500/day, but not exceeding 20,000 baht" before you are allowed to leave the Kingdom. The Trat Immigration Office adds that the cap is reached for overstays of 40 days or longer.

Your permitted stay is whatever was stamped at arrival, plus any extension you were granted. Since 15 September 2026, most visa exempt arrivals get 30 days, not 60, according to the Department of Consular Affairs. People who plan on the old number are the easiest overstays of the year.

What happens if you overstay in Thailand by 1 to 3 days?

You pay the fine at departure, receive an overstay stamp, and fly. For a short overstay settled voluntarily at the airport, no ban applies. Juslaws and Consult, a Bangkok law firm, describes short overstays as resolved by paying the fine directly at the immigration checkpoint at the airport.

One published source is stricter. The Trat Immigration Office page states that since 20 March 2016 even a one day overstay brings a five year ban. This post follows the ladder published by the Samut Prakan Immigration Office, which Visa Check also uses, where the five year ban applies to people arrested with under one year of overstay. Confirm with the immigration counter before you rely on either reading.

The departure sequence, as the published sources describe it:

1. You join the normal departure immigration queue.
2. The officer checks your passport and sees that your permitted stay has ended.
3. You are sent to pay the fine at the immigration counter. Thai Law Online notes that fines are usually paid at airport immigration counters when you leave.
4. You pay in Thai baht. The Trat Immigration Office advises having enough cash with you, so carry more baht than the arithmetic says.
5. You receive the overstay stamp in your passport and continue to your gate.

Children under 15 are not fined, according to the Trat Immigration Office, but they still receive the overstay stamp. A family of two adults and two children with a three-day problem pays 3,000 THB and collects four stamps.

What is the Thailand overstay ban after 90 days?

Past 90 days, leaving voluntarily brings a re-entry ban that grows with the length of the overstay. The Samut Prakan Immigration Office publishes the full ladder:

Is it worse to be caught than to surrender?

Yes, by a wide margin. Look at the two bottom rows of the table: someone arrested inside Thailand with an overstay under one year faces a five year ban, while the same person who surrenders at the airport with under 90 days faces none. Juslaws and Consult makes the same distinction: people who approach the authorities and pay are treated differently from people found at a checkpoint, who are subject to arrest and prosecution.

The legal basis sits in the Immigration Act B.E. 2522. Thai Law Online quotes Section 81: a foreigner who stays without permission, or after permission has expired, faces "imprisonment not exceeding two years, or a fine not exceeding twenty thousand baht, or both." The 500 THB daily fine is the administrative settlement of that offence, which is why it only works when you cooperate.

Does the overstay stamp affect future visas?

The stamp stays in that passport for as long as the passport is valid. It records that you left later than permitted, and any immigration officer who opens the passport can see it: at your next arrival, or when you apply for an extension or a Destination Thailand Visa. No published rule turns a short, paid overstay into a refusal. Officers have discretion, though, and the stamp is part of what they look at. The fine is money. The record is what lasts.

How do you avoid an overstay from a Thai island?

Build a buffer before you need it. Islands in the western Gulf of Thailand, Koh Tao and Koh Samui included, have their wettest period from October to December, according to ExplorerTom's Gulf weather guide. Wonderland Koh Tao, a local operator, says Lomprayah ferry cancellations are rare, two or three times across several years. Rare is not never, and one cancelled boat on your last legal day is enough.

1. Work out your last legal day on the day you arrive. Visa Check shows your permitted stay and extension options for your passport.
2. Put an alarm three days before the last legal day, and five days before in October to December.
3. Never plan to leave an island on the last day of your stamp. Reach the mainland first, then fly.
4. If you need more time, ask for the extension early. The fee is 1,900 THB per application at the Immigration Bureau (Trat Immigration Office fee list), on form TM.7, usually for up to 30 more days (Chiang Rai Times, 2026). 5. Photograph your entry stamp on arrival, so you can check the date without digging out your passport.

If you have already passed your date, go to the airport or an immigration office and settle it. Do not wait to be found.

What does an overstay cost next to the legal options?

A few days of overstay can look cheaper than an extension, and that is the wrong comparison. Five days costs 2,500 THB against 1,900 THB for a 30 day extension, and the extension leaves no stamp.
